Discussions between Experts

Discussions between Experts are intended to help identify areas of agreement and disagreement between opposing experts, and to narrow down the matters still in dispute.
In recent years much greater emphasis has been placed on discussions between experts in an attempt to save court time, reduce legal costs and to bring about an early settlement between the parties, particularly in civil courts.
But all too often expert witnesses are unaware of their legal responsibilities and how to properly conduct themselves when involved in discussions of this kind. A poorly conducted meeting can adversely affect both the expert and the outcome of a case - see Jones v Kaney  SC and Trebor Bassett Holdings Ltd & Anor v ADT Fire and Security PLC  TC
There is an increasing theme of the courts encouraging instructing lawyers to actively monitor the expert witness and their performance – see Kennedy v Cordia  SC. This, coupled with the removal of expert witnesses’ immunity from suit, means it is now more important than ever that experts are equipped with the requisite skills and knowledge to enable them to effectively fulfil their duties when partaking in discussions between experts and preparing joint statements.
