AEC can provide expert witness services in health and safety and specifically asbestos and Legionella consultancy. Our experts, with individual experience in excess of 25 years each, have provided independent expert evidence to the court in both criminal i.e. for defendants in prosecutions, and civil i.e. for the claimant or defendant in private proceedings, and also joint reports to the court and for mediation purposes.
AEC's experts understand the history of asbestos, its uses, its regulatory history, its epidemiology, and the UK's current statutory requirements (and those in other countries such as Ireland and Hong Kong) and can therefore provide factual independent opinion to the court in such cases. Our expert witnesses have provided expert witness services to the court on defendant's compliance with current regulations, as well as possible historical exposures to asbestos on behalf of claimants and their estates.
Furthermore, AEC's experts can advise on Legionella compliance and risk, acting as expert witnesses to the court in both criminal i.e. for defendants in prosecutions, and civil i.e. for the claimant or defendant in private proceedings, and also joint reports to the court.
Enforcing authorities will offer advice and information to the duty holder if they are failing to comply. However, where appropriate, improvement notices, prohibition orders or formal cautions may be issued and enforced; in this case specialist experts might need to get involved in these investigations, either as part of the investigation team, or as an independent expert witness.
